Overview of the case against Ducky Bhai:

On Monday, the National Cyber Crime Investigation Agency (NCCIA) requested the court to extend the judicial remand of Ducky Bhai for an additional 8 days. However, the Lahore District Court rejected the request.

Judicial Magistrate Naeem Wattoo presided over the hearing. Investigating officer Shoaib Riaz also asked for an extension in the remand of Ducky Bhai. But the court also denied his request.

On August 17, the case was filed against him. The NCCIA Lahore has filed a case against him under sections 13 (Electronic Forgery), 14 (Electronic Fraud), 25 (Spamming), and 26 (Spoofing) of the Prevention of Electronic Crimes Act 2016, as well as sections 294b (offering prize in connection with trade), and 420 (Cheating and dishonestly inducing delivery of property) of the Pakistan Penal Code.

It’s been 22 days, and Ducky Bhai is still in custody of the NCCIA. His last remand ended on September 5. 

Advocate Chaudhry Usman Ali, legal counsel of Ducky Bhai, said that financial records could be obtained without keeping the accused in custody. So, why is it not pondering the bail plea? He also questions how Ducky Bhai is responsible for the financial losses of the users. 

Ducky Bhai bail plea:

Under Section 497 of the Code of Criminal Procedure, Ducky Bhai’s counsel files a post-arrest bail plea. The plea stated that the FIR against him is totally false and has nothing to do except to humiliate him publicly.

The application also claimed that when Ducky Bhai promoted these apps, there was no official government notification declaring them illegal. Moreover, investigators have no evidence of his cheating, forgery, spamming, or spoofing.

The counsel also stated that under sections 294-B and 420, Ducky Bhai can also request bail. In addition, there is no one who came to the front, claiming financial loss due to Ducky Bhai.

The plea also stated that Ducky Bhai will not flee and that he has no criminal record prior. The bail is now under consideration before the court. It has also issued a notice to the NCCIA for September 12 on the bail petition.
